Terms of service

Sales - All sales are limited to and made conditional upon terms and conditions contained herein. The objection of Buyer to any of the terms contained herein shall be deemed to have been waived if we do not receive the objection in a written notice within 10 days of receipt of order, acknowledgement or invoice or before any part of the described goods are accepted by the Buyer, whichever occurs first. Seller reserves the right to reject orders at any stage before dispatch

Warranty Disclaimer - All made or distributed by Seller are inspected before shipment. If any goods prove to have been defective in material or workmanship at time of shipment and a claim is made by Buyer in the manner set forth below, Seller will repair or replace the non-conforming goods, at Seller's option, unless otherwise agreed by Seller in writing. Seller makes no warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. In no event shall Seller be liable to Buyer for incidental or consequential damages.

Pricing - Except where noted otherwise, the List Price or Suggested Price displayed for products on any Services represent the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price or Suggested Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that are offered as a set, the List Price or Suggested Price may represent "open-stock" prices, which means the aggregate of the manufacturer's estimated or suggested retail price for each of the items included in the set. The List Price or Suggested Price may be provided by the seller.

With respect to items sold by the seller, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If the correct price of an item sold by the seller is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other seller's may follow different policies in the event of a mispriced item.

Claims - Claims for shortages, defects and non-conforming goods must be made by the Buyer in writing within three (3) days of receipt of the goods, and no claims made after the expiration of such period will be entertained or allowed. Such writing shall state with particularity all material facts concerning the claim then known to the Buyer. Buyer shall hold the goods complained of intact and in no event shall return any goods to Seller unless expressly authorized to do so in writing by Seller.

Payment - If you pay by credit/debit card, we will deduct the amount due from your account as soon as your order is placed for standard products leaves our warehouse. Prices and terms of payment are shown on the applicable order and receipt forms and/or invoice forms. All payments shall be made in the U. S. dollar currency. Any amounts past due are subject to a service charge of 1.5% per month on the unpaid balance, unless applicable laws require a lesser charge.

Sales Tax - The appropriated State sales tax will be applied regarding shipment in the state of Florida only. Florida does not charge sales tax on U.S. flags and Florida state flags. This was enacted by the Congress of the United States. flagpoles, other states flags, country flags and football flags are taxable, as are all shipping charges.

Freight/Shipping - All costs of freight, transportation or mailing, unless pre-paid, and all demurrage charges shall be paid by the Buyer. Buyer shall also pay for all increased freight rates whether prepayment has been made or not.

Shipping information cannot be changed once you submit your order. If you ship to a P.O. Box with no street address and you select a shipping method other than USPS, you may be charged an additional fee of $10.00 per package for ground shipping, and $15.00 per package for any express shipping service. US Flag Supply reserves the right to change your shipping method to USPS Priority Mail at our discretion. If you have entered an invalid address and any correction needs to be made by any of our carriers, you can be charged an additional fee of $10.00 per package for ground or economy service and $15.00 per package for any express shipping service. Please read over your order carefully.

Delivery - Delivery of the goods by Seller to the carrier at the point of origin shall constitute delivery of the goods to Buyer and thereafter the shipment of the goods shall be at the Buyer's risk. All claims and allowances for damage to merchandise incurred in transit must be filed against and presented to the carrier by the Buyer. Goods shipped are insured at cost of Buyer. For any reason a delivery is refused or considered undeliverable, due to an invalid shipping address, buyer will be charged a penalty that may include, but not limited to extra shipping charges.

Delays - All orders are accepted by Seller upon the express understanding by Buyer that Seller shall not be liable for delays in delivery of the goods or inability to deliver the goods caused by or due to inability to obtain transportation, equipment or material, out of stock or by reason of insurrection, fires, floods, storms, embargoes, actions of any military or civil authorities, whether legal or de facto, strikes, labor difficulties, riots, lock-outs, acts of God or other similar or different circumstances beyond control of the Seller.

Our right to not accept your order or cancel your purchase - We reserve the right to refuse any order for whatever reason. We also reserve the right to cancel any purchase (an order already accepted by us) without being liable for any damage or costs.

Returns - All returns must be authorized in advance by Seller should it be necessary to return merchandise. Please call our Customer Service Department at (904) 241-0080. You will be assigned a Return Merchandise Authorization Number. This number must appear on the outside of the package returned. Packages sent C.O.D. will not be accepted. Custom, non-stock and special order items are not returnable. Returns unrelated to variation from item ordered or merchandise quality/condition may be subject to a 30% restocking charge.

Shortages - While the information published on the site is believed to be accurate at the time of publication, the Seller offers this site and the information contained herein without any warranty, express or implied, and is not liable for mistakes, errors or omissions of any kind, nor for any loss or damage caused by a user's reliance on such information. All information is subject to change without notice.

Shipping/Handling Fees - Non-refundable.

Custom Goods/Special Orders - Custom made goods are subject to variation in quantity of 3 or more. All orders are subject to a plus/minus 10% variance. Custom orders are accepted from the Buyer only on the basis the final invoice will reflect the actual quantity delivered, and the Buyer agrees to accept and pay for all overruns. Custom orders, non-stock, MTO “made to order” and special order items cannot be cancelled and Buyer will be charged for his order. All prices and specifications are subject to change without notice. Custom/special orders are non-refundable/non-returnable. This includes, flags, lapel pins, custom items, embroidered, headers, fly end corners, engraving plates, flags that are for indoor use, with pole hem and/or fringe, and any international or state flags over 5ft. x 8ft. or larger. These flags are not stock items and are MTO “made to order”. Seller will not be liable or held responsible for misspelled orders placed online by the Buyer. Proof-read all orders.
